Below are two of the articles appearing in the fall issue:
Reconstructing Ripeness I: A Study of Constructive Engagement in Protracted Social Conflicts Peter T. Coleman, Ph.D., Antony G. Hacking, M.A., Mark A. Stover, M.A., Beth Fisher-Yoshida, Ph.D., Andrzej Nowak, Ph.D.
What moves people to work with each other rather than against each other when locked-into destructive, long-term conflicts? Ripeness theory has been a useful starting point for understanding such motives, but has limited explanatory power under conditions of intractable conflict. This paper is the first of a two-part series that presents the findings from a study that explored various methods of eliciting constructive engagement from stakeholders - through interviews with expert scholar-practitioners working with protracted conflicts. These interviews provide new insights into constructive conflict engagement. The findings in this paper and its companion piece have immediate relevance for practitioners and scholars working on international and intergroup conflicts.
Alternative Dispute Resolution in Medical Malpractice: A Survey of Emerging Trends and Practices Susan J. Szmania, Addie Johnson, and Margaret Mulligan
This study summarizes the survey findings from thirteen organizations offering ADR services in medical malpractice cases. We discuss the types of disputes handled, the ADR systems utilized, the typical case outcomes, and the staff qualifications. We also report on the challenges and successes that these ADR programs faced, including the impact of recent legislation on medical malpractice litigation. The results highlight the central role of communication in resolving conflict following unexpected medical errors.

Conflict Coaching Committee News During the Conflict Coaching Committee’s last teleconference on November 10, 2008, Sam Slosberg provided an interesting and comprehensive overview of the conflict coaching program at the Transportation Security Administration (TSA), a Division of Homeland Security. Slosberg, who is a Conflict Management Specialist with TSA, spoke about the many considerations in developing a program of this nature, including the elements of training and developing coaches, selecting coaches, how the process and coaches are measured, and so on. The Arizona Association for Conflict Resolution’s (AACR) first membership meeting of the New Year will be held at Phoenix School of Law in Phoenix on Saturday, January 31, 2009, from 10:00 a.m. - 12:30 p.m., followed by networking and lunch. Arizona Attorney General Terry Goddard has been invited to speak and AACR will present him with an award for the Office of the Attorney General for 25 years of service and support of alternative dispute resolution in the community. More details to follow.
Please join the Maryland
Chapter of ACR on Monday, December 15, 2008 from 6:00 p.m. to 8:30
p.m. at our Annual Membership Meeting, Election and Program.
Refreshments will be served.
The New Jersey Chapter held its annual meeting honoring Dr. Robert Angelo of Rutgers University for his contributions to mediation. Among other things, Dr. Angelo is the chair of the NJ Mediation Board.
Elected to leadership were President, Arthur L. Finkle, Advanced Mediator, and Don Dileo. Membership includes 35 members and 75 quasi-members.
The New Jersey Chapter sends a bulletin to members each month of items of interest in the conflict resolution community.
As a young Chapter (first officer elections were in June 2008), we are thrilled to announce our continuing excitement for the mission of ACR. Since our elections, our motivated group has participated in a community breakfast honoring Conflict Resolution Day, obtained a Proclamation from Governor Sanford, and now we celebrate the completion of our first Annual Meeting on Saturday, November 22. The meeting was a tremendous success, with an opening that spotlighted ADR history from Bill Drake and Mary Bryan, followed by a panel discussion, moderated by Crystal Frechette, of the wide scope of fields within the good work of conflict resolution (Amos Workman-law practice/mediation, Pat Brandon-education, Beth Padgett-mediation center, Donna Roberson-workplace and Judy Burton-juvenile justice arbitration). We networked during our lunch and held our business meeting to discuss our current activities and the direction of the Chapter. We concluded the day with two outstanding speakers to further example the importance of conversation. Barbara Brown, from Clemson University shared her fascinating work in deliberative dialogue on key topics that affect society. And Jessie Washington, Jr., the Commissioner for the SC Human Affairs Commission, helped us understand the role of mediation within his agency and reminded us all of the critical importance of mutual understanding and moving forward. What an inspirational beginning. We are all proud to be a part of this meaningful network.
